Terms of Service
- Legal Agreement
a) These Terms of Service (“TOS”) constitute a legally binding agreement between you and GROUP ONE MEDICAL CLINIC (“GROUP1”), encompassing our affiliates and distributors (referred to as “we” or “us”), who own and/or operate: (1) the websites located at www.grouponeclinic.com (the “Websites”); (2) the associated standalone Group1 virtual care platform (“G1VCP”); (3) the Group One virtual clinics (“Virtual Clinics”); and (4) all other services provided by us through the G1VCP, Virtual Clinics, or as described on the Websites (the “Platforms”).
b) By using the Platforms, you enter into a legally binding agreement with us. The term “you” refers to the individual or entity accessing the Platforms, browsing or otherwise utilizing the Platforms, or receiving any services through the Platforms. These TOS cover situations where you may utilize the Platforms on behalf of another individual, such as a child or someone for whom you have legal authority, in which case references to “you” and “your” may include that individual.
c) IMPORTANT! BY ACCESSING AND UTILIZING THE PLATFORMS, YOU ACCEPT AND AGREE TO BE BOUND BY AND COMPLY WITH THE TOS. ACCESSING THE PLATFORMS CONSTITUTES YOUR ACCEPTANCE OF THE TOS AND INDICATES YOUR INTENT TO BE LEGALLY BOUND BY THEM. IF YOU DO NOT ACCEPT AND AGREE TO THE TOS, PLEASE REFRAIN FROM ACCESSING OR USING THE PLATFORMS.
d) THE PLATFORMS ARE NOT TO BE USED FOR MEDICAL EMERGENCIES. In case of a medical emergency, call 911 immediately or go to the nearest hospital emergency room. Never attempt self-treatment based on any content of the Platforms.
e) THE PLATFORMS DO NOT SUBSTITUTE THE ADVICE AND MEDICAL CARE OF YOUR PRIMARY DOCTOR OR HEALTHCARE PROVIDER.
f) These TOS outline the terms and conditions for accessing and using the Platforms. We reserve the right to amend, modify, and revise these TOS at any time without notice. Your use of the Platforms after such changes are posted will indicate your acceptance of the revised TOS.
- Health Services and Support Services via the Platform
a) By using the Platforms as permitted by us and the TOS, you can access health care professionals (“HCPs”) and personal health assistants (“PHAs”) via phone, secure text, and/or video for telemedicine and telehealth consultations, as well as obtain general information about diseases and conditions and administrative support services via telemedicine and telehealth (“Health Services” and “Support Services,” respectively).
b) HCPs may provide assessments, diagnoses, order tests, and prescribe treatments, including medications, as appropriate. Health Services provided via the Platforms do not replace the care provided by your primary doctor or primary care provider, nor do they replace in-person healthcare interactions.
c) HCPs have sole authority to determine appropriate Health Services for you. While you may request specific tests, treatments, prescriptions, or other Health Services, HCPs are not obligated to provide them if deemed inappropriate.
d) As stated in these TOS, we provide and support the technology facilitating your access to HCPs and/or PHAs, along with all necessary support and technology services. GROUP1 is not liable for the Health Services or Support Services provided by HCPs or PHAs on the Platform, nor for their handling of your personal information (“PI”) and personal health information (“PHI”).
e) The information provided on the Site, including blogs, is not intended as medical advice. Consult a medical professional for any medical concerns or emergencies.
- Access and Use of the Platforms
a) The Platforms allow HCPs and PHAs to receive your PI and PHI and provide Health Services or Support Services to you. Your use of the Platforms does not establish or govern your relationship with the HCP or PHA. You acknowledge us as your service provider, and we may add or remove HCPs and PHAs on the Platform without guaranteeing access to the same individuals on each visit.
b) To use the Platforms, you must be at least 18 years old.
c) BY USING THE PLATFORMS, YOU WARRANT THAT: (1) YOU HAVE REACHED THE LEGAL AGE OF MAJORITY IN YOUR JURISDICTION OR YOU ARE LEGALLY AUTHORIZED TO CONSENT TO THE USE OF THE PLATFORM FOR THE INDIVIDUAL USING IT; (2) YOU HAVE THE LEGAL CAPACITY TO ENTER INTO A BINDING AGREEMENT; (3) YOU WILL COMPLY WITH THESE TOS; (4) ALL INFORMATION PROVIDED BY YOU ON THE PLATFORM IS TRUE, ACCURATE, CURRENT, AND COMPLETE; AND (5) IF YOU ARE USING THE PLATFORM ON BEHALF OF ANOTHER PERSON OR ENTITY, YOU HAVE THE AUTHORITY TO BIND THEM TO THESE TOS.
d) We reserve the right to deny access to the Platforms, Health Services, or Support Services to anyone at any time and for any reason, including for violating the TOS. You must cease use immediately upon our request.
e) You agree to communicate respectfully via the Platforms with HCPs, PHAs, and others. Contact HCPs and PHAs only through the Platforms for Health Services or Support Services.
f) In addition to Health Services and Support Services, the Platforms enable HCPs and yourself to upload and store PHI, share PHI with HCPs and PHAs, and receive electronic prescriptions and documents. Optional services such as transferring a summary report about your Health Services or prescriptions to a chosen physician or pharmacy are also available.
- Virtual Clinic Specific Information
a) HCPs on the Virtual Clinics are independent, regulated health professionals, registered to provide certain health services in one or more Canadian provinces or territories.
b) HCPs on the Virtual Clinics may operate within or outside your province or territory of residence as permitted by their regulatory authority. More information about any particular HCP can be found on their governing body’s website or the associated website’s register of HCPs.
- Limitations on Health Services and Support Services
a) Telemedicine or telehealth involves using information and communication technologies for distant health care where the patient and physician/healthcare provider are not in the same location. HCPs and PHAs may ask about your health history, current condition, symptoms, and prescribed treatments. HCPs may conduct visual examinations or ask you to perform self-assessments.
b) Health Services and Support Services do not replace your primary care relationship with your family doctor or primary care health professional. Continue consulting them regularly or as advised.
c) HCPs may refer you to specialists for in-person consultations, report consultation results, prescribe medication, and follow up on treatment outcomes. You have the right to ask questions and withdraw consent to treatment.
d) Risks associated with telemedicine include limitations in assessments and potential breaches in security protocols.
e) Certain Health Services may not be available depending on your jurisdiction and location. Some conditions require in-person consultations.
f) HCPs cannot prescribe certain medications, including narcotics, via the Platforms. If necessary, they may advise in-person consultations.
g) DO NOT USE THE PLATFORMS FOR EMERGENCY MEDICAL NEEDS. IN CASE OF A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.
g) YOU ARE STRICTLY PROHIBITED FROM USING THE PLATFORMS FOR EMERGENCY MEDICAL NEEDS. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, IMMEDIATELY CALL 911 OR GO TO YOUR NEAREST EMERGENCY ROOM.
h) HCPs and PHAs maintain the discretion to refuse or discontinue providing Health Services or Support Services at any time and for any reason, including if they deem the Health Services inappropriate for the circumstances or detect actual or potential misuse. Your HCP may decide that specific Health Services, tests, treatments, or prescriptions are unsuitable for some or all of your treatment needs, and may opt not to provide them via the Platforms.
i) Like any other healthcare service, using the Health Services carries inherent risks, as does relying inappropriately on Support Services.
j) Telemedicine entails additional risks that may hinder HCPs’ ability to provide Health Services or PHAs’ ability to offer Support Services, including but not limited to:
i) poor quality audio-video connections due to remote locations or network limitations, potentially hindering proper assessment or information gathering;
ii) delays in evaluation or treatment due to technological failures;
iii) lack of access to your health records maintained outside the Platforms, which could lead to adverse reactions or errors; and
iv) unauthorized collection, use, or disclosure of your PHI due to security breaches.
k) Support Services are designed for general educational purposes only and do not constitute Health Services. PHAs may provide non-specific information about diseases or conditions without diagnosis or treatment recommendations. Support Services do not replace consultations with qualified regulated health professionals.
6) Privacy
a) Our Privacy Policy, accessible in the footer of our home page, governs the collection, use, and disclosure of PI and PHI. By accessing and using the Platforms, you agree to abide by its terms.
b) Each HCP and PHA operates under their own privacy policies and may retain your PI and PHI off the Platform to comply with professional regulations. Consult your HCP or PHA to understand their data collection and retention practices.
7) User Accounts
a) To access Health Services or Support Services, you must create a user account (the “User Account”) and obtain username and password login credentials (“User ID”). Safeguard your User ID. We reserve the right to deactivate any User Account at our discretion. Deactivation may prevent access to the Platforms, content, account details, or user content.
b) Health Services and Support Services may be accessible to children with HCP or PHA discretion, but the User Account holder for patients under 18 must be their parent or legal guardian. If registering on behalf of a minor, create separate profiles for each dependent and ensure compliance with these TOS. Children must use the Platforms under parental or guardian supervision.
c) To close your User Account, email [email protected]. Account closure will disable access and render PI and PHI inaccessible.
8) Intellectual Property
a) All intellectual property rights related to the Platforms, including patents, copyrights, trademarks, and trade secrets, belong to us or our licensors. Unless granted in the Limited Licenses herein, any use, modification, distribution, or exploitation of the Platforms, in whole or in part, is prohibited without our express written consent.
b) Use of the Platforms or these TOS does not grant you rights to use our brand elements, logos, trademarks, or those of our licensors.
9) Limited License
Subject to these TOS, you are granted a limited, non-transferable, non-exclusive license to access and use the Platforms for personal, non-commercial purposes. Use for any other purpose is prohibited. Additional requirements for special content usage may apply, and usage periods may be prescribed.
10) Software License
a) All Software on the Platforms is protected by copyright and other intellectual property laws. You are granted a personal, non-transferable license to access and use the Software embedded in the Platforms, subject to these TOS and any additional conditions. Usage periods may apply.
b) If downloadable, Software usage is subject to specific terms and conditions. You may install and use the Software for personal, non-commercial purposes, with limitations outlined in these TOS. Unauthorized actions, such as decompiling or reverse engineering, are prohibited.
c) Except as expressly permitted, you may not reproduce, modify, or distribute the Software. No rights beyond the limited license granted herein are conferred. The Software is provided “as is,” with no warranties of any kind.
